Anambra Govt Launches Plea Bargain Initiative to Decongest Prisons, Courts

The Anambra State Government has introduced a wide-ranging plea bargain initiative aimed at reducing overcrowding in correctional centres and clearing the backlog of criminal cases pending before courts across the state.

Under the initiative, defendants facing criminal trials will be eligible for the discretionary plea bargain arrangement, except those charged with murder, kidnapping, armed robbery and rape.

The State Attorney-General and Commissioner for Justice, Dr. Tobechukwu Nweke, SAN, disclosed this in a statement issued on Wednesday.

According to Nweke, the directive, dated July 22, 2026, requires prosecutors across the state to provide prescribed plea bargain forms to eligible defendants before their pleas are formally taken in court.

The initiative is part of the broader criminal justice reforms being implemented by the administration of Governor Chukwuma Charles Soludo to address overcrowding in correctional facilities and reduce the volume of cases awaiting trial.

“This is a rare discretionary privilege offered as part of our ongoing efforts to decongest correctional centres and the courts,” the Attorney-General said.

Under the arrangement, defendants who voluntarily plead guilty to eligible offences may receive reduced sentences from the courts, subject to the applicable legal procedures and judicial approval.

The government said the policy is intended to facilitate quicker resolution of criminal cases while providing an opportunity for eligible defendants to benefit from a more efficient justice process.

Prosecutors have consequently been directed to attach the relevant plea bargain forms to eligible case files before arraignment proceedings.

The exemption of murder, kidnapping, armed robbery and rape cases from the programme means that defendants facing those charges will not be covered by the broad discretionary arrangement.

The state government said the initiative formed part of efforts to modernise the justice system and improve access to justice, while ensuring that courts and correctional facilities are not overwhelmed by cases that could otherwise be resolved through legally recognised alternative mechanisms.

Plea bargaining generally involves an agreement in which a defendant pleads guilty to an offence in exchange for concessions, which may include reduced charges or a lighter sentencing recommendation, subject to the approval of the court.

The practice is widely used in several jurisdictions as a means of managing criminal caseloads and speeding up the resolution of cases.

The Anambra initiative, according to the state government, is expected to provide prosecutors and defendants with an additional mechanism for resolving eligible criminal matters without subjecting every case to a prolonged trial.

The government said the reform would complement other measures being pursued under the Soludo administration to improve the efficiency of the state's judicial infrastructure and strengthen access to justice.
